UK Law

Under the Health and Safety at Work Act 1974, all employers must ensure the health, safety and welfare of employees and record significant findings. Failure to maintain adequate H&S records can result in HSE enforcement action, unlimited fines and prosecution.

Regulation Guide

What Does UK H&S Law Require?

The Health and Safety at Work Act 1974 (HSWA) is the primary piece of health and safety legislation in Great Britain. It places a general duty on all employers to ensure, so far as is reasonably practicable, the health, safety and welfare of all employees and others who may be affected by their work activities.

Under the Management of Health and Safety at Work Regulations 1999, employers must carry out suitable and sufficient risk assessments and record the significant findings. Supporting regulations — COSHH 2002, DSE 1992 and the Manual Handling Operations Regulations 1992 — add specific documentation requirements on top of this general duty.

For H&S teams managing multiple sites and dozens of staff, keeping on top of assessments, review dates and documentation is a significant operational challenge. CertFlow brings every assessment, record and certificate into one simple system.

FAQs

Common Questions About H&S Compliance & CertFlow

Everything you need to know about UK Health and Safety regulations and how CertFlow supports your team.

The HSWA 1974 places a general duty on all employers to ensure, so far as is reasonably practicable, the health, safety and welfare of employees and others affected by their work. Under the Management of Health and Safety at Work Regulations 1999, employers must also carry out suitable risk assessments and record significant findings. The HSE can issue improvement notices, prohibition notices and prosecute for failures to comply.
Under COSHH Regulations 2002, assessments must be reviewed regularly and whenever there is reason to suspect they are no longer valid — for example after a change in substances, processes or following an incident. As a general rule, assessments should be reviewed at least every two years. CertFlow tracks review dates and flags overdue assessments automatically across all your sites.
Under the DSE Regulations 1992, employers must carry out assessments for all workers who regularly use display screen equipment as a significant part of their work. This includes office staff, remote workers and anyone using computers, laptops or tablets for extended periods. Assessments must be reviewed when there is a significant change to the workstation setup or the user’s circumstances.
The MHOR 1992 require employers to avoid hazardous manual handling where reasonably practicable, assess risks that cannot be avoided, and reduce the risk of injury. Assessments must cover the task, individual capability, the load and the working environment. All assessments must be documented and reviewed following any incident or significant change in the work activity.
